Volunteer Lawyer Responsibilities
Preparing for a hearing generally involves the following steps:
- Conducting an initial intake interview with the client.
- Obtaining and reviewing a copy of the client's Social Security file.
- Obtaining and reviewing all of the client's updated medical records.
- Assisting the client in obtaining a form evaluation from his or her treating physician(s) or
psychiatrist(s) regarding the client's ability to work.
- Preparing an "opening statement" (i.e., an informal legal brief) that
summarizes the medical evidence and sets forth the legal theory of disability.
This letter and any additional evidence you have secured should be submitted to the
Administrative Law Judge at least one day prior to the hearing.
- Preparing the client to testify at the hearing; usually this takes place the day
before the hearing.
- Representing the client at the hearing.
Post hearing matters will in most instances remain the responsibility of the Legal Aid Society.
